1. Introduction

We are pleased that you have chosen Brixel (hereinafter also referred to as “Brixel”, “we”, “us”, or “our”). By registering for or using Brixel's websites and the associated services and software applications (collectively, the “Brixel Services” or “Services”), or by accessing content or material provided by Brixel as part of the Services (the “Content”), you are entering into a binding contract with Brixel AG, headquartered in Zurich, Switzerland.

Your contract with us includes these Terms of Use (“Terms”) and our Privacy Policy (collectively, the “Agreements”). You can review the current versions of all Agreements at any time on the Brixel website. By stating that you have read and understood these Agreements, you accept them and are bound by them. If you do not agree, you cannot use the Brixel Services or access Brixel's Content.

Please read the Agreements carefully. They contain important information about the Brixel services provided to you. The agreements include information about future changes to the agreements, limitations of liability, data protection information, and dispute resolution through arbitration instead of a court of law.

You can correct any data you enter during registration. To do so, either return to the previous pages and correct the incorrect entries or go to your user account or the editor for your property.

To use Brixel services, you must (1) be 18 years of age or older, (2) be legally authorized to enter into a legally binding contract with us and not be prevented from doing so by applicable law, and (3) be a resident of a country where the services are offered. You also warrant that the information you provide to Brixel during registration is true, correct, and complete, that your information is accurate at all times, and that you are authorized to provide this information.

2. Contract amendments

We may amend these agreements from time to time at our discretion. If we make material changes to the agreements, we will notify you in a prominent and appropriate manner. This may be a prominent notice within the services or an email. In some cases, we will notify you in advance, and your continued use of our services will constitute your acceptance of the changes. Therefore, please ensure you read these notices carefully. If you do not wish to continue using the services under the new agreements, you may terminate them by simply notifying us.

3. Our Services & Costs

We provide a service that allows users who have created an account to create real estate websites, list properties for sale, conduct searches, offer services, communicate with other users, and order services offered by other users.

Certain Brixel services are available to you free of charge. Other services require payment before you can access them. You can find more information about our services on our website.

From time to time, we may offer trials of paid services for a specific period, either free of charge or at a reduced price. Brixel reserves the right to determine your eligibility at its sole discretion and to modify or withdraw your eligibility at any time, in accordance with applicable law, without prior notice and without incurring any liability, to the fullest extent permitted by law.

4. Rights we grant you

Brixel services and content are the property of Brixel or Brixel's licensors. We grant you a limited, non-exclusive, revocable license to use Brixel services and a limited, non-exclusive, revocable license to use the content for personal, non-commercial purposes. This license remains in effect unless terminated by you or Brixel. You agree that you will use all Brixel services for personal use only and will not redistribute or transfer them. If you do not, you must notify us in writing in advance.

5. User-generated content

As a user, you can publish, upload, and/or contribute content to the service, including, for example, images, text, messages, information, and/or other content (“user-generated content”). For the avoidance of doubt, “user-generated content” refers to all content uploaded or published in any part of the Brixel services.

With respect to all user-generated content, you represent and warrant that (1) you are authorized to share such content, and (2) such content or its use by Brixel does not violate any agreements, applicable laws, or rights of ownership, publicity, privacy, or other rights of any person, nor does it imply endorsement of your user-generated content by Brixel without your express written consent.

Brixel is entitled, but not obligated, to monitor, review, or edit user-generated content. In all cases, Brixel reserves the right to remove user-generated content or block access to it for any reason whatsoever that, in Brixel's sole discretion, violates the agreements. Brixel may take these measures without prior notice to you or any third party.

6. Obligations you have towards us

You are obligated to prevent unauthorized access to the software and services by taking appropriate measures.

You are responsible for entering and maintaining your data and information for using the software and services. You must create a "user identity" to use Brixel's service. You are obligated to keep your "user identity" and password confidential and not disclose them to unauthorized third parties.

Depending on the chosen plan, you are obligated to pay us one-time, monthly, or annual fees for using the software services and data hosting. We are entitled to change the fees and update the services and will therefore notify you of these changes in writing with at least one month's notice if these changes are reasonable for you. The basis and reason for such changes are technical improvements and further developments of the software and services. If you are not willing to continue the contract under these new conditions, you are entitled to withdraw from the contract as soon as the new fees take effect.

7. User Guidelines

Brixel respects intellectual property rights and expects the same from you. We have established some basic rules that you must follow while using the service. The following are strictly prohibited:

Copying, redistributing, reproducing, “ripping”, recording, transmitting, performing or publicly displaying, sending, making available to the public, or otherwise using any part of the Brixel service or content in a manner not expressly permitted in the agreements or under applicable law, or which infringes the intellectual property rights (such as copyrights) in the Brixel services or content or parts thereof;
To transfer copies of content from the cache of an authorized device to another device;
Reverse engineering, decompilation, disassembly, modification or creation of derivative works relating to the Brixel service or content or parts thereof, unless permitted by applicable law;
Circumvention of any technology used by Brixel, its licensors or third parties to protect the content or services;
Sale, rental, sublicensing or leasing of any part of the Brixel service or content;
Circumvention of the territorial restrictions applied by Brixel or its licensors;
Removing or altering notices relating to existing copyrights, trademarks or other intellectual property rights contained in or provided through the content or services (including for the purpose of concealing or altering information about the owner or source of content);
Sharing your password with any other person or using another person's username and password;

“Crawling” Brixel’s services or using other automated methods (including bots, scrapers and spiders) to view, access or collect information from Brixel or Brixel’s service.

8. Advertising

We may allow third-party advertising from partners to be placed on the platform. We assume no responsibility if a user enters into an agreement with any of the companies or individuals advertising on the platform.

9. Data Hosting

We host the customer's data on a server. We are responsible for ensuring that the data is accessible via the internet platform www.brixel.ch. You agree not to store any data on the internet platform www.brixel.ch that violates laws or agreements with third parties. We are obligated to take appropriate measures against data loss and unauthorized access to your data by third parties. We perform daily backups. You remain the sole owner of your data in all cases and can therefore request the return of all data at any time, particularly after termination of the contract, without us having any right of retention.

10. Customer Support

We respond to customer inquiries (via email, phone, in-app chat, or WhatsApp) regarding the use of the software and services related to this agreement during business hours, Monday through Friday, from 9:00 AM to 12:00 PM and 1:00 PM to 5:00 PM. Beyond these hours, we welcome any inquiries and strive to respond as quickly as possible.

11. Intellectual Property

11.1. Regarding the platform and services

We reserve all rights to the website and the services offered.

11.2. Regarding created user profiles

The profiles are your intellectual property. You grant us permission to store and use the data and products you provide and that are stored for you, to the extent necessary to provide the service. The data may also be used in the event that the service is updated.

12. Liability

12.1. Brixel's Liability

We accept no liability for damages you incur through the use of the platform, unless these are due to gross negligence or intent. You are responsible for ensuring adequate virus protection; we accept no liability whatsoever for viruses transmitted during the use of the website or services.

12.2. Your liability

You assume liability for all data uploaded under your user account, especially in the event that it infringes intellectual property rights or laws.

13. Warranty

We do not guarantee the accuracy of the platform's content or user-generated content. Likewise, we cannot guarantee uninterrupted access to or availability of the service.

14. Data security

We take appropriate measures to ensure that the data stored in our facilities is protected from unauthorized access. However, you are responsible for the strength and security of your own password.

16. Final Provisions

16.1. Applicable Law and Jurisdiction

The legal relationship between you and us is governed by Swiss law. The exclusive place of jurisdiction for disputes arising from or in connection with this legal relationship is Zurich, Switzerland.
